§ 1. Plain-English Summary

In plain English: Most states with a charitable solicitation statute require a registered charity to tell donors, in writing, where the donor can independently verify that the charity is real and registered. Some states dictate the exact words. We list those words here, by state, and we keep them current. Until BeneVets actually completes registration in a given state, the registration number in that state's block is a placeholder. We will not solicit in a state until we are registered there.

BeneVets keeps these disclosures accurate by (a) running this page through the Treasurer's annual renewal review, (b) updating registration numbers within fifteen business days of receipt from each state agency, and (c) version-stamping the page so donors can see when it last changed.


§ 2. Master 501(c)(3) Status Statement

BeneVets, Inc. is a 501(c)(3) tax-exempt public charity, EIN 99-3359742. Contributions are tax-deductible to the extent allowed by law.

This statement leads every donor-facing communication. Per-state language follows it; it does not replace it.


§ 3. Per-State Disclosure Blocks

§ 4. Composite Single-Paragraph Disclosure

The composite paragraph below is the version used in space-constrained surfaces (email footers, social-media bios, donation receipts when the long form is impracticable). The long-form per-state language at benevets.org/state-disclosures controls in case of conflict.

Florida is broken out of the composite because Florida's statute prescribes verbatim ALL-CAPS language whose substitution by a shortened cross-reference is not safe.


§ 5. URS (Unified Registration Statement) Participating States

The Unified Registration Statement, developed by the National Association of State Charity Officials (NASCO) and the National Association of Attorneys General (NAAG), is accepted in lieu of (or alongside) state-specific initial-registration forms in the cooperating states listed below. BeneVets's policy is to file via the URS wherever the state accepts it and to supplement with the state's specific schedule or addendum where required.

URS-cooperating states (as of July 4, 2026; updated on annual review):

Alabama, Alaska, Arizona, Arkansas, California, Connecticut, District of Columbia, Georgia, Illinois, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Utah, Virginia, Washington, West Virginia, Wisconsin.

URS acceptance is moving target; several states (notably Florida, Colorado, Hawaii, Oklahoma) have migrated to electronic-only state-specific filings. Treasurer to confirm URS acceptance each renewal cycle.


§ 6. Non-URS / State-Specific Registration Required

The following states either do not participate in the URS or require submission only on their proprietary form / electronic portal: Colorado, Florida, Hawaii, Oklahoma. Additionally, several states accept the URS for initial registration only and require their own forms for renewal - Treasurer to maintain a per-state matrix. A handful of states do not have a charitable solicitation registration regime at all (e.g., Delaware, Idaho, Indiana, Iowa, Montana, Nebraska, Nevada, South Dakota, Texas (limited), Vermont, Wyoming). BeneVets may solicit in those states without registration, but the per-state composite disclosure should still travel with all national-footprint solicitations.


§ 7. Renewal Cadence and Responsibility

Most states require annual renewal. Several states tie renewal to the IRS Form 990 due date (with extensions); others run on calendar year. One designated officer maintains the master renewal calendar. Recommended assignment, subject to Board ratification: Treasurer (Callie). Recommended cadence and controls:

  • A master spreadsheet (registration matrix) keyed by state, agency, statutory cite, filing form, due date, fee, paid amount, registration number, expiration date, audit-threshold trigger, and renewal-confirmation document filename.
  • A calendar reminder ninety, sixty, thirty, and seven days before each due date.
  • The Treasurer presents the matrix at each quarterly board meeting; the Secretary archives the previous quarter's matrix snapshot in the corporate records vault.

§ 8. Audited-Financial-Statement Thresholds

Many states condition initial or continuing registration on the filing of an independent CPA review or audit at specific gross-contribution thresholds. The table below lists thresholds for the top ten states by donor concentration risk for BeneVets. Thresholds change; Treasurer verifies each renewal.

BeneVets's Year-1 fundraising plan targets $25,000 - $75,000, which falls well below all of the above thresholds. The first state likely to trigger any independent-CPA filing requirement on BeneVets's projected trajectory is New Jersey at $25,000 (review) or Massachusetts at $200,000 (review). Treasurer to flag at $20,000 (NJ) and $180,000 (MA) anticipated annual contributions.


§ 9. Professional Fundraiser Disclosures

Reserved. BeneVets does not, as of July 4, 2026, engage a professional fundraiser, professional fundraising counsel, or commercial co-venturer. If BeneVets engages any such party:

  • Additional registration of the professional fundraiser will be required in most of the disclosure states above, and a separate contract-filing obligation may apply (e.g., New York, Florida, California AB 488 platform-charity rules where the fundraiser is a charitable fundraising platform).
  • Per-solicitation disclosure language must identify the professional fundraiser by name and disclose, on request and sometimes proactively, the percentage of contributions paid to the fundraiser.
  • This section must be replaced with active language before any professional-fundraiser engagement begins.

Cross-reference: California AB 488 (effective 2024) imposes additional obligations on charitable fundraising platforms and platform charities. If BeneVets ever uses a third-party donation platform that meets the AB 488 definition, the platform-charity obligations under Cal. Gov. Code § 12599.9 apply.


§ 10. Internet Solicitation: The Charleston Principles

In plain English: Putting a "Donate" button on a website that anyone in the country can see is not the same thing as actively asking residents of a particular state for money. The Charleston Principles, adopted by state charity regulators in 2001, try to draw a line between passive web availability and active targeting. The line is not bright, and several states have rejected the Principles entirely. The honest answer is that there is genuine ambiguity, and the cautious posture is to register everywhere BeneVets actively solicits.

The Charleston Principles (NASCO, March 2001) suggest registration is triggered where any of the following apply:

  1. The charity's non-internet activities (mail, phone, in-person, targeted email) would by themselves trigger registration in the state; or
  2. The charity actively solicits residents of the state through interactive web functionality or targeted electronic communications; or
  3. The charity receives contributions from residents of the state on a repeated and ongoing basis or a substantial basis through its website.

BeneVets's posture at v1:

  • California (domicile): Register. Required as a foundational matter independent of solicitation activity.
  • Donor email program: When activated, the donor email program constitutes targeted electronic communication. BeneVets will treat the recipient's state of residence as the applicable state for registration purposes and will not send donor-appeal email to residents of a state in which BeneVets is not registered. Transactional and newsletter emails are not donor solicitations and do not trigger this restriction.
  • Passive website availability: BeneVets's website does not include on-site donation processing at v1 (per master context § 2.15). When on-site donation processing launches, the Treasurer must complete registration in the priority disclosure states (above) before the donate button is activated.
  • Ambiguity acknowledgment: Several states (notably Florida and New York) have taken positions more aggressive than the Charleston Principles, treating receipt of any donation from a state resident as a trigger. The cautious course is to be registered in every state where BeneVets either actively solicits or has reason to expect repeated contributions.

§ 11. Records Retention

Charitable solicitation registration filings, renewals, financial reports submitted to state agencies, correspondence with state regulators, professional-fundraiser contracts (if any), and acknowledgment letters are retained for seven (7) years from the date of filing or expiration, whichever is later. Records are stored in the corporate records vault under the Treasurer's custody. Cross-reference Document 14 (Data Retention Schedule) and Document 18 (Document Retention Policy).


§ 12. Conflicts of Interest

If a member of the Board of Directors, the Executive Director, or any officer of BeneVets receives compensation from a solicitation-related contract (including any professional-fundraiser engagement, commercial co-venture, or charitable-sales-promotion arrangement), additional state disclosures may apply, including:

  • Disclosure of the conflicted interest at the time of contract approval, per Document 17 (Conflict of Interest Policy).
  • Disclosure to the state charity regulator in California and certain other states as part of registration renewal.
  • Disclosure in the IRS Form 990, Schedule L (Transactions with Interested Persons).

The Walter / nonvoting-CEO posture (no compensation at v1) currently presents no conflict of this type. The Treasurer must re-screen on any change in officer compensation status.


§ 13. Restricted Gifts and UPMIFA

Donor-restricted gifts are subject to the Uniform Prudent Management of Institutional Funds Act, codified in California at Cal. Prob. Code § 18501 et seq. BeneVets honors donor restrictions consistent with UPMIFA's prudent-management standard and the release / modification procedures it permits. Specific donor-facing language on restrictions, gift acceptance, and modification appears in the Donor Privacy Policy (Document 09) and Donor Bill of Rights (Document 10), to which this Document cross-refers.


§ 14. Combined Federal Campaign

The Combined Federal Campaign (CFC) operates under a separate registration and disclosure framework administered by the U.S. Office of Personnel Management under 5 C.F.R. Part 950. BeneVets is not currently a CFC-participating charity. If BeneVets later applies, a separate disclosure package will be prepared. Reserved.


§ 15. Currency and Limitations Disclaimer

This page lists BeneVets's current charitable solicitation registrations and the donor-notice language each state requires. BeneVets cannot lawfully solicit contributions from residents of a state in which it is not registered. The donor's state of residence is treated as the applicable state for purposes of which disclosures apply. Where this page and the underlying state statute differ, the statute controls. BeneVets will update this page within fifteen business days of any registration grant, denial, renewal, or lapse.

Placeholder registration numbers are clearly marked [ ... PENDING]. Until the placeholders are replaced with actual registration numbers, BeneVets is not registered in the corresponding state and will not solicit in that state.
